General terms and conditions of use and business for consumers

The use of the services offered by canncura GmbH, (hereinafter referred to as “canncura”) is subject to the following general terms and conditions of use and business (hereinafter referred to as “terms of use and business”)

1. General

These terms and conditions of use and business are intended to regulate the contractual relationships between the user and canncura conclusively or at least in the essential points and generally apply to all contracts that canncura concludes with you as part of this service offer.

The terms and conditions of use and business apply to canncura’s range of services. You can access the range of services via the canncura online platform (www.canncura.de and possibly other associated domains) as well as in the branches of the service providers that cooperate with canncura (e.g. doctor's practices).

canncura's range of services is aimed exclusively at consumers within the meaning of Section 13 of the German Civil Code (BGB). You then act as a consumer within the meaning of § 13 BGB if you conclude a contract with canncura primarily for private and not for business purposes. Commercial use of canncura's services is therefore excluded. Entrepreneurs within the meaning of Section 14 of the German Civil Code (BGB) cannot and should not become a contracting party to a contract or agreement that is concluded on the basis of these terms and conditions of use and business.

The canncura offer is aimed exclusively at natural persons who are at least 18 years old.

In principle, canncura does not recognize any deviating conditions. Anything else only applies if canncura unilaterally declares something different to you expressly and in writing or makes a different agreement with you expressly and in writing.

The content published as part of canncura's range of services (e.g. texts, images and videos) is generally protected by copyright and is usually the property of canncura or licensed accordingly.

2. Scope of services

canncura offers the provision of medical advice on the online platform www.canncura.de as well as on site and in the branches of our partner doctors or medical/telemedical and pharmaceutical services, which aim in particular at specialized therapy with cannabinoids.

To this end, canncura cooperates contractually with independent and self-responsible service providers (e.g. doctors and pharmacists). Canncura does not provide any medical and/or pharmaceutical services, but acts exclusively as an intermediary and thus enables you to have reliable, service-oriented and secure access to services. The provision of the specific medical, telemedical and pharmaceutical services is carried out exclusively and under legal responsibility by the cooperation partners working with canncura.

The use of the services offered by canncura's cooperation partners (e.g. doctors and pharmacists) is generally subject to a fee (such as treatment within the framework of a treatment and fee contract in accordance with Section 630a of the German Civil Code (BGB) or the purchase of cannabinoid-based medicines from a pharmacy). For information on processing payments, please refer to point five (5) “Cancellation fee, cancellation and rebooking” of these terms and conditions of use. Further information about the payment methods accepted by canncura can be found on our online platform at www.canncura.de.

canncura reserves the right to expand or adapt the range of services for the future or to completely delete services from the range of services in justified individual cases. We will inform you in a timely manner about any future changes to canncura's range of services via the canncura online platform at www.canncura.de as part of the online platform, by email and also in the branches of our cooperation partners.

3. Legal relationship and conclusion of contract

The use or utilization of canncura's range of services is only possible after prior conclusion of an effective contract based on these terms and conditions of use and business.
